Terms of Service
Effective date: [EFFECTIVE DATE]. This is a draft template and is not yet in effect.
1. Who we are
StoragePipeline is operated by [COMPANY LEGAL NAME], a [STATE] company located at [ADDRESS] ("we", "us"). These Terms govern your use of StoragePipeline (the "Service"). By creating an account you agree to them on behalf of yourself and your organization.
2. Bring your own keys: you are the sender
The Service lets you place calls, send texts, send mail and send email through provider accounts you own and connect (for example your own telephony, mail and email accounts). For every call, text, letter and email sent through the Service, you are the caller and sender of record, not us. You are solely responsible for complying with all laws that apply to your outreach, including:
- TCPA (Telephone Consumer Protection Act) and FCC rules: obtaining any required consent, honoring quiet hours, scrubbing against the National Do Not Call Registry and your own internal do-not-call list, and honoring revocations of consent;
- CAN-SPAM: accurate header and sender information, non-deceptive subject lines, a valid physical postal address in every commercial email, and honoring opt-out requests promptly;
- state telemarketing, mini-TCPA and texting laws, which may be stricter than federal law;
- carrier rules for business texting, including brand and campaign registration.
3. Compliance tools are not a guarantee
The Service provides tools to help, such as quiet hours, Do Not Call scrubbing, a consent ledger, litigator flags, STOP handling and email unsubscribe links. These tools depend on the data and settings you provide and may not catch every case. We do not guarantee that your use of the Service complies with any law. Consult your own attorney about your outreach program.
4. Data sources and accuracy
Information in the Service comes from (a) public records, such as county parcel and assessor data and court and recorder filings; (b) data you upload or enter; and (c) your own connected provider accounts. Public records can be incomplete, out of date or wrong. The Service labels values as on record, estimate or missing and shows the source where it can, but all data is provided as is. Verify anything you rely on before you make an offer or a decision.
5. Owner-data restrictions
Some states limit how owner and assessor data may be used. For example, Idaho Code §74-120 bars using certain public-records owner information for mailing lists or other solicitation. You must follow every such limit that applies to the data you use. The Service shows a warning before displaying data it knows is restricted, but the responsibility to comply is yours.
6. Acceptable use
You will not use the Service to: send unlawful, deceptive or harassing messages; contact people who have opted out; violate privacy, consumer protection or anti-discrimination laws; resell or bulk-redistribute data obtained through the Service; probe, overload or attack the Service; or share accounts beyond your licensed seats. We may suspend accounts that put recipients, carriers or the Service at risk.
7. Billing
Subscriptions are billed through Stripe at the plan price shown when you buy. StoragePipeline charges no platform fee on your usage: calls, texts, mail, data and AI are billed by those providers directly to your own accounts. Free trials end on the date shown in the app. You can cancel any time; access continues through the end of the paid period. Fees are non-refundable except where the law requires otherwise. [REFUND TERMS]
8. Your data
You own the data you upload and create in the Service. You grant us a limited license to host and process it only to provide the Service to you. You can export your data at any time while your account is active and for [NUMBER] days after it ends.
9. Disclaimers and limits of liability
The Service is provided "as is" without warranties of any kind, to the extent the law allows. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental or consequential damages, or for fines or claims arising from your outreach. [ATTORNEY TO REVIEW]
10. Indemnity
You will defend and indemnify us against claims arising from your outreach, your data, or your breach of these Terms, including claims under the TCPA, CAN-SPAM and state telemarketing laws.
11. Changes, governing law, contact
We may update these Terms with notice in the app or by email. These Terms are governed by the laws of [STATE], with venue in [COUNTY], [STATE]. Questions: [email protected].
